The Supreme Court has scheduled April 10 to deliver judgment on a case aimed at overturning a directive issued by the Food and Drug Authority (FDA).
The directive in question prohibits well-known individuals, including musicians, from participating in the advertising of alcoholic beverages.
In 2016, the FDA introduced guidelines for the advertisement of foods and beverages, specifying that no well-known personalities or professionals should be used in alcoholic beverage advertisements.
The plaintiff in the case, Mark Darlington Osae, who is an artiste manager, argues that the directive is discriminatory and unconstitutional.
Osae is seeking an injunction against the Food and Drugs Authority, interpreting Article 17 of the constitution to deem the directive as discriminatory.
The case, filed in November 2022, is scheduled for determination by the court, with the Supreme Court adjourning the matter to April 10 for judgment.
