Former Energy Minister, Boakye Agyarko, has criticized Dr. Kwabena Donkor for what he deems as unfortunate and irresponsible comments regarding a $140 million judgment debt that Ghana is facing.
Agyarko’s response came after the former Power Minister called for a parliamentary investigation into the decision to terminate the power purchase agreement with the Ghana Power Generating Company (GPGC), including the role of the then-Energy Minister.
Dr. Kwabena Donkor asserted that the termination of the GPGC contract didn’t make commercial or legal sense at the time.
He also argued that the government’s failure to negotiate the termination and explore more reasonable alternatives is to blame for the current situation.
In response, Boakye Agyarko expressed his disappointment with Dr. Kwabena Donkor’s assertions. Agyarko emphasized that neither he nor his Ministry had the authority to unilaterally cancel or terminate a contract of this nature.
He explained that an Inter-Ministerial Committee, chaired by Dr. Alfred Ofosu Ahenkora, Executive Secretary of the Energy Commission, had reviewed the fiscal and legal implications of Power Purchase Agreements (PPAs) executed by the Electricity Company of Ghana (ECG).
The committee’s report was submitted on April 5, 2019, and it was further reviewed by the Attorney-General before being approved by Cabinet for implementation.
