Assin North MP Position Declared Vacant

Chairperson of the Electoral Commission, Cyril Kwabena Oteng Nsiah has officially declared the vacancy of the Parliamentary Membership position vacant in the Assin North Constituency.

According to a notice issued today, he indicated that “the occurrence of the vacancy was necessitated by the Judge of Supreme Court, dated 17th May 2023 in respect of James Quayson in the case of Michael Ankomah Nimfan vrs James Gyakye Quayson.”

The Supreme Court declared the election of James Gyakye Quayspn as Member of Parliament for Assin North void and unconstitutional.

The panel consisted of seven judges presided over by Justice Jones Dotse.

The Supreme Court declared the election of James Quayson, who owed allegiance to a different country, as inconsistent and violated Article 94 of the 1992 Constitution of the Republic of Ghana.

The court, thereby, ordered Parliament to expunge his name as MP from the records.

The panel which consisted of Justice Jones Victor Dotse, Justice Nene Amegatcher, Justice Mariama Owusu, Gertrude Araba Torkornoo, Justice Prof. Henrietta Mensa-Bonsu, Justice Yonny Kulendi, and Justice Barbara Ackah-Yensu declared that Mr. Quayson was not qualified at the time he contested the election in 2020.

The Electoral Commission has, therefore, declared the position vacant and thereby appeals to all aspirants to follow the necessary procedures.
